By using this website or purchasing products from NZ Foiling, you agree to these Terms & Conditions.
1. ABOUT NZ FOILING
NZ Foiling is a New Zealand-based supplier of foiling equipment and related products.
Our website is provided primarily to showcase our products, provide information and allow customers to get in touch with us. We do not currently operate an online checkout or online store through this website.
Product enquiries, purchases and payment arrangements are handled directly with NZ Foiling.
2. PRODUCT INFORMATION
We aim to provide accurate and up-to-date information about the products featured on our website.
Product specifications, colours, designs, availability and other details may change from time to time as manufacturers update their products.
Images shown on the website are for illustration purposes and may not always represent the exact product, colour or specification supplied.
If you have any questions about a product or its suitability, please contact us before purchasing.
3. PRICING & QUOTES
Prices displayed on the website, where provided, are subject to change.
Where a specific price or quotation is provided to you by NZ Foiling, that price will be valid for the period stated in the quotation or, where no period is stated, for a reasonable period.
Any applicable freight, delivery or other additional costs will be discussed with you before your purchase is confirmed.
4. PRODUCT AVAILABILITY
Product availability can vary depending on manufacturer stock and international supply.
Where a product needs to be ordered specifically for you, we will provide an estimated timeframe where possible. Any timeframe provided is an estimate and may be affected by manufacturer, freight or other circumstances outside our control.
5. PAYMENT & PURCHASE
Purchases are arranged directly with NZ Foiling.
Payment terms and the agreed purchase price will be confirmed with you before the purchase is completed.
For products that need to be specifically ordered or sourced for you, we may require payment or a deposit before placing the order with the manufacturer or supplier.
Once an order has been confirmed with a manufacturer or supplier, cancellation may not be possible where the product has been specifically sourced for you.
Any cancellation or refund will be considered in accordance with these Terms & Conditions and applicable New Zealand consumer law.
6.DELIVERY & COLLECTION
Delivery or collection arrangements will be agreed with you at the time of purchase.
Where products are sent by courier or freight provider, delivery timeframes are estimates only and may be affected by circumstances outside NZ Foiling's control.
You are responsible for providing accurate delivery information.
7. RETURNS AND CHANGE OF MIND
If you change your mind about a purchase, NZ Foiling may, at its discretion, offer an exchange or return where the product is unused, in its original condition and packaging.
Special-order or specifically sourced products may not be eligible for return where they have been ordered specifically for you.
This does not affect any rights you may have under the New Zealand Consumer Guarantees Act or other applicable legislation.
8.FAULTY OR DAMAGED PRODUCTS
If you believe a product is faulty, damaged or does not match what you purchased, please contact NZ Foiling as soon as reasonably practical.
We may ask for photographs or other information and may need to inspect the product before determining the appropriate remedy.
Where a product does not meet the guarantees required under New Zealand consumer law, NZ Foiling will provide the appropriate remedy in accordance with the law.
Depending on the circumstances, this may include a repair, replacement or refund.
Nothing in these Terms & Conditions limits or excludes your rights under the New Zealand Consumer Guarantees Act.
9. MANAFACTURER WARRANTIES
Some products supplied by NZ Foiling are covered by a manufacturer's warranty.
Where a manufacturer's warranty applies, we will assist with genuine warranty claims where appropriate.
Manufacturer warranties are subject to the relevant manufacturer's warranty terms and conditions.
Manufacturer warranties do not replace or limit any rights you may have under New Zealand consumer law.
10. EQUIPMENT SELECTION AND ADVICE
Foiling is a technical watersport and equipment should be selected with consideration to the rider's experience, ability, size, weight, riding style and the conditions in which the equipment will be used.
NZ Foiling is happy to provide advice and recommendations to help customers choose appropriate equipment.
However, customers are ultimately responsible for ensuring that the equipment they use is suitable for their own ability and intended use.
If you are unsure about the suitability of a particular product, please contact us before purchasing.
11. SAFETY
Foiling is an active watersport and involves inherent risks, including falls, collisions, impact with equipment, underwater hazards, changing weather and water conditions, and the possibility of serious injury.
Customers are responsible for using equipment in accordance with the manufacturer's instructions and safety recommendations.
Appropriate safety equipment should always be used, and riders should ensure they have the skills and experience appropriate for the equipment and conditions.
Information provided by NZ Foiling is not a substitute for proper training, instruction or independent assessment of conditions.
